MEC Calls for Better Use of Labour Laws to Reduce Misconduct in Health Facilities

The Gauteng Department of Health’s Advisory Appeals Committee (AAC) plays a vital role in promoting ethical leadership, sound governance, and fair dispute resolution, particularly through adherence to labour laws.
This was emphasized by MEC for Health and Wellness, Nomantu Nkomo-Ralehoko, during a strategic stakeholder workshop on 5 September 2025.
MEC Nkomo-Ralehoko highlighted the AAC’s critical contribution to the department, especially in managing labour appeals and private hospital licensing. These functions impact both healthcare services and staff welfare.
“The AAC’s responsibilities directly affect healthcare facilities and employee well-being,” said the MEC. “They ensure compliance with laws and uphold the rights of healthcare workers.”
Enhancing Governance and Internal Processes
The workshop offered a chance for AAC members, departmental officials, and key stakeholders to assess the committee’s performance from January to June 2025. Discussions focused on strengthening governance and streamlining processes to align with Labour Laws and relevant policy frameworks.
One key development was the inclusion of Human Resources and Labour Relations officials in AAC meetings since late 2024. This collaboration has improved internal communication and led to better decision-making.
“We’ve seen significant improvements in coordination,” said MEC Nkomo-Ralehoko. “The involvement of HR and Labour Relations officials has helped us address challenges in healthcare facilities.”
Addressing Misconduct and Strengthening Labour Law Implementation
A major issue discussed was the rise in misconduct cases, particularly absenteeism. MEC Nkomo-Ralehoko called for stronger implementation of Labour Laws, including the Public Service Act, to reduce errors and ensure fair outcomes.
“We need a deeper understanding of Labour Laws to protect employee rights and uphold the department’s integrity,” said the MEC. She emphasized the importance of using Labour Laws effectively to prevent misconduct and ensure accountability in healthcare facilities.
The Role of Ethical Leadership in Labour Law Applications
Advocate Fezeka Magano reminded participants of the broader responsibilities of presiding officers in disciplinary processes. She stressed that while presiding officers manage hearings independently, they must ensure fairness and adhere to Labour Laws.
“When you serve as a presiding officer, your conduct must reflect institutional values,” explained Advocate Magano. “You must prioritize fairness and legal compliance in your decisions.”
She also noted that presiding officers should consider the broader impact of their decisions on the workforce, employer, and public trust. Adhering to Labour Laws ensures justice for all parties involved.

Moving Forward: Strengthening Labour Laws and Healthcare Governance
MEC Nkomo-Ralehoko concluded the workshop by praising the AAC’s dedication to ethical leadership and good governance. She emphasized that their work is crucial in maintaining public trust and ensuring compliance with Labour Laws.
“Your commitment to ethical leadership and adherence to Labour Laws is vital to earning the trust of staff, partners, and the communities we serve,” she concluded.
